Welder claims to be victim of workplace race discrimination

An individual has no choice in what his or her race will be. Being discriminated against on this basis may therefore seem unfair and cause frustration for an employee in California. Race discrimination is not simply unjust; it is illegal. If individuals are mistreated because of their skin color, they have the right to seek justice.

This type of situation recently took place in another state. In this case, a rig welder decided to sue his employer after it allegedly discriminated against him due to his race. The man worked for a construction company, and he claims that he was subject to severely racist comments.

The company was also discriminatory in other ways, such as denying him pay for his work, according to his complaint. The employer also purposely did not give him extra work assignments, he said. The man is pursuing financial damages for items such as unpaid wages.

It is unlawful for an employer in California to demote, fire or deny the pay of an employee simply because he or she is a certain race. If this happens in our state, the wrongly treated employee has the right to file a race discrimination claim against the applicable employer. Monetary relief from a successfully fought case may include back pay and other types of relief, based on what is deemed appropriate in the specific situation. A person who has been wrongfully terminated also could be reinstated in his or her job. It is necessary to prove that racial discrimination actually took place in order to succeed in this type of case.
